विगत चार हजार वर्षदेखि आजको दलित समुदायमाथि हुँदै आइरहेको जातीय छुवाछूत, ज्यादती, त्यसबाट सृजित चरम यातना, मानसिक सामाजिक र शारीरिक चोटलाई केही राहत प्रदान गर्न राज्यले २०६३ देखि प्रत्येक २१ जेठलाई जातीय भेदभाव तथा छुवाछूत उन्मूलन दिवसको रूपमा मनाउँदै आएको छ । २०६३ साल जेठ २१ गते सरकारले नेपाललाई जातीय छुवाछूत मुक्त राष्ट्र घोषणा गरेको थियो ।
२०६३ को पुनः स्थापित संसदबाट नेपाललाई छुवाछूत मुक्त राष्ट्र घोषणा गरेको आज १६ वर्ष भएको छ । जातीय छुवाछूत विरुद्ध राज्यबाट २०६८ मा जातीय विभेद तथा छुवाछूत कसुर र सजाय ऐन पारित भएको थियो । त्यस्तै, २०७२ को संविधानको प्रस्तावनाले समानुपातिक समावेशीकरण सिद्धान्तलाई आत्मसात् गरेको छ । नेपालको संविधान २०७२ का केही मौलिक अधिकारका विभिन्न धारा जस्तै, धारा २४ लाई छुवाछूत तथा भेदभाव विरुद्धको हक भनेको छ । धारा ४० लाई दलितको हक र धारा ४२ समानताको हक भनी स्थापित गरेको छ । राज्य जातीय विभेद विरुद्ध नेपालमा प्रचलित कानुनमा मात्रै सीमित छैन । विभिन्न अन्तर्राष्ट्रिय सभा सम्मेलनका घोषणापत्रमा जातीय छुवाछूत उन्मुलन गर्छु भनी हस्ताक्षरसमेत गरेको छ ।
विडम्बना राज्यको यो अथक प्रयास र मिहिनेत कानुनका पानामात्र सीमित जस्तो देखिएको छ । केही प्रगतिशील जमातका लागि मात्र कानुन भएको आभास भएको छ । आजको समय, जसलाई हामी आधुनिक र प्राविधिक युग भन्छौँ । आविष्कार र विकासका विभिन्न ढाँचामा अध्ययन मननमा रमाइरहेका छौँ । फ्यासन् अर्थात् परिवर्तनको कुरा गर्छौ तर हाम्रो सोच संस्कार परिवर्तन भएको देखिँदैन । सामान्यभन्दा सामान्य घटना घट्दा हामी जात विशेषलाई आधार मानेर गालीगलाेजमा उत्रिएका छौँ ।
दलित समुदाय यहीँ समाजको एउटा अहम् हिस्सा हो । जनसङ्ख्या, भाषा, धर्म, संस्कृतिको आधारमा दलितको उपस्थिति पनि गैरदलित बराबर रहेको छ । तर दलित समुदाय विगत चार हजार वर्षदेखि कथित जातको आधारमा २१ शताब्दीको आधुनिक कालमा पनि विभिन्न सामाजिक मानसिक शारीरिक यातना भाेग्नु परेको छ, सुन्नु परेको छ र निर्लज्ज भएर देख्नुपरेको छ । यो अवस्थामा राज्यको छुवाछूत मुक्त नीति कहाँ गयो ? कथित गैरदलितकाे चेतनास्तर कहाँ पुग्यो ?
पहिला शिक्षा, चेतना र कानुन थिएन । समाज कथित धार्मिक र सामाजिक संरचनाका आधारमा चलेको थियो । धर्म, जातले निश्चित समुदायलाई संरचनात्मक लाभांश प्रदान गरेको थियो । जातकै आधारमा काजी, मुखिया, जिम्वाल, पण्डित तोकिएको थियो । अहिले दृश्य फेरिएको छ, नेपाल पनि विश्व राजनीतिक र भूमण्डलीकरणको एक हिस्सा भएको छ । विश्वव्यापी अभ्यास गरिएका रूपान्तरण र परिवर्तन देखेको मुलुक हो । दुर्भाग्यवश, नेपाली समाज जातीय छुवाछूतको सवालमा खुङ्खार कालकार साबित भएको छ । नेपाली उखान ‘मुखमा रामराक बगलीमा छुरा’ भनेझैँ देखिएको छ । बाहिरी रूपमा सब बराबर तर जब सम्बन्ध र सांस्कृतिक पक्ष अगाडी आउँछ तब जातवादीको मुकुन्डो देखाउन अग्रसर जमातको बाक्लो उपस्थिति देखिएको छ ।
नेपाली समाजमा बाहिरबाट हेर्दा मानिस मुक्त देखिएको हुन्छ । सबै उस्तै, देखिन्छन्, भाषा, भेष, रहनसह,न धर्म, रीतिरिवाज तर जब हामी व्यक्तिको भित्री पाटो हेर्छौँ,, तब ऊ कुल पितृ, गोत्रको कालो जाँतोमा बाँधिएको हुन्छ । कुल, गोत्र, पितृ कथित उच्च जातलाई मानवताबाट पन्छाएर उसलाई एउटा निश्चित जातमा बाँधिदिएकाे हुन्छ । त्यहीँ कथित जातले उसमा दानवीय प्रवृत्ति हाबी भएको देखिन्छ । त्यसका कयौँ उदाहरण हाम्रै वरिपरि देखिएका छन् । हामी कुल र गोत्रको कालो जालमा बसेर मानवता, भाइचारा, एकता बिर्सिएर विभाजनको खेल खेलिरहेको देख्न सक्छौँ । हामी कथित जातकाे खाडल ओढेर सम्बन्धहरू चुँड्न तम्तयार हुन्छौँ । यहाँसम्म कि मान्छे मार्न पनि तयार भएको विभिन्न घटनाक्रमले त्यसको पुष्टि गरेको छ । अर्कोतिर कानुनका धारा, दफालाई खुलेआम चुनौती दिएर गिज्याइरहेका छौँ । दलितमाथि गैरदलितकाे गालीगलाेज, हीन नजर त मानौँ कथित उपल्लो जातको थेगो भएको छ । दैनिक जीवनसँग जोडिएको अभिन्न अङ्ग भएको आभास हुन्छ । यस्तो अवस्थामा राज्यले वार्षिकरुपमा जातीय छुवाछूत उन्मुलन दिवसको मनाउनुको अस्तित्व के ? छुवाछूत तथा भेदभाव मुक्त राष्ट्रकाे सङ्कल्प कति जायज हुन्छ ?
धेरै गैरदलित जमातको भ्रामक प्रतिप्रश्न के छ भने, दलितले भनेजस्तो जातपात केही छैन । हामी सब बराबर, जातीय छुवाछूत पहिला जस्तो अब रहेन । तर समाजमा देखिएका दृश्यले गैरदलितले प्रतिप्रश्न गरेको जस्तो देखिँदैन । अझ अहिले जातीय छुवाछूतका नयाँ रूपहरूले देखिएका छन् । पहिला तँ भनी विभेद गर्नेले अहिले ‘तिमी र तपाईँ’ सम्बोधन गरेर विभेदलाई निरन्तरता दिएको पाइन्छ । पहिला घरको आँगनमा टेक्न नदिनेले अहिले घरकाे आँगनमा टेक्न दिए तर थर सुन्ने बित्तिकै बहाना बनाएर दलितलाई कोठा नदी जातीय विभेदलाई निरन्तरता दिएको पाइन्छ । शब्दमा परिवर्तन भयो, तँ बाट तिमीसम्म पुग्यो, झुपडी महल भयो, दुईवटा कोठा दर्जन भए तर व्यवहार र आचरण उस्तै छ । विभेदको जालो झन् जेलिएको छ ।
सहरमा जातकै आधारमा दलितले कोठा नपाउने, जात थाहा नपाउन्जेल सबै ठिक हुने, जात थाहा पाएपछि तुरुन्तै जानुपर्ने ? गाउँमा जातीय धारा छुट्टाछुट्टै बनाउनुपर्ने, दलितले पानी छोए, जरिवाना, कुटपिट र मानसिक यातना दिइने ! दलितका भैँसीको दूध नकिन्ने, अन्तर्जातीय प्रेम, विवाह अस्वीकार, तिरस्कार र बहिष्कार गर्ने, यो एक्काइसौँ शताब्दीको समाजवाद उन्मुख संविधान भएको राष्ट्रकाे दृश्य हो ? अब भन्नुस् दलितको अवस्था कहाँ छ ? नेपाली समुदायको विभेदप्रतिको चिन्तन कस्तो छ ? यस्तो अवस्थामा जातीय छुवाछूत उन्मुलन दिवसको सार्थकता भनेको जातीय छुवाछूतका घटना सार्वजनिक गरिनु, भाषण दिनु, श्रद्धाञ्जली लगायतका आश्वासन दिन बाहेक केही देखिएको छैन ।
